2. Use License

Permission is granted to temporarily access the materials on HailingSA's website and mobile application for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to reverse engineer any software contained on HailingSA's platform
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or "mirror" the materials on any other server

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your password and identification
  • Accept all responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Service Description

HailingSA is an e-hailing platform that connects passengers with drivers. We provide a platform for users to request transportation services. HailingSA does not provide transportation services directly and is not a transportation carrier. We are a technology platform that connects passengers with independent third-party drivers.

5. User Conduct

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit any harmful, offensive, or illegal content
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any portion of the Service
  • Harass, abuse, or harm other users
  • Impersonate any person or entity

6. Payment Terms

Payment for rides is processed through the Service. You agree to pay all charges associated with your use of the Service. All fees are non-refundable unless otherwise stated. HailingSA reserves the right to change pricing at any time with reasonable notice.

7. Cancellation Policy

Users may cancel rides subject to our cancellation policy. Cancellation fees may apply if a ride is cancelled after a certain time period or if the driver has already arrived at the pickup location. Specific cancellation terms will be displayed at the time of booking.

8. Limitation of Liability

HailingSA acts as an intermediary between passengers and drivers. We are not responsible for the conduct of drivers or passengers. To the maximum extent permitted by law, HailingSA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9. Indemnification

You agree to indemnify and hold harmless HailingSA, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

10. Modifications to Terms

HailingSA reserves the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through appropriate legal channels.
